الرقابة المتبادلة بين المؤسستين التنفيذية والتشريعية في النظام الدستوري الجزائري وأثرها على مبدأ الفصل بين السلطات

Abstract

هذا البحث يستحضر مجمل الآليات الرقابية المتبادلة بين السلطتين التنفيذية والتشريعية، وتحليل واقع العلاقة بينهما، وكيف تأثر كل سلطة على الأخرى، وقياس مدى فعالية الوسائل الرقابية الممنوحة لكل منهما، لمعرفة إن كان المؤسس الدستوري الجزائري خلال تعديل دستور 1996 المعدل سنة 2016 أقام نوع من التوازن بين السلطات أو لا، باعتبار أن الهدف من الرقابة سواء البرلمانية التي تمارس على السلطة التنفيذية، أو التأثير المتنوع الممنوح للسلطة التنفيذية في مواجهة السلطة التشريعية، الهدف منه كبحعنان كل منهما وحتى لا تستبد كل سلطة بصلاحياتها، لتحقيق مبدأ الفصل بين السلطات و بناء دولة القانون.. This research evokes the whole supervisory mechanisms exchanged between the executive and legislative powers, analyzes the real relationship between them, how each authority influences the other, and measures the effectiveness of the monitoring tools granted to each, to see if the Algerian constitutional founder during the amendment of the 1996 Constitution amended in 2016. established a kind of balance between the authorities or not, considering that the purpose of parliamentary oversight exercised on the executive power, or the diverse influence granted to the executive authority over the legislative authority, its aim is to rein in each other and not to overthrow each authority with its powers, in order to achieve the principle of separation of powers, and building the rule of law.
