الآليات القانونية لاستغلال العقار في مجال الاستثمار السياحي المستدام

Abstract

يعد العقار السياحي ركيزة أساسية لتحقيق التنمية السياحية المستدامة، لما يوفره من فرص لتوسيع العرض السياحي وتحسين جودة الخدمات، وقد واكب تطويره تحديث الإطار القانوني والمؤسساتي مع تبسيط الإجراءات الإدارية وتعزيز الضمانات القانونية لتشجيع واستقطاب الإستثمار لاسيما الأجنبية منه، كما تؤدي الهيئات الإدارية وفي مقدمتها الوزارة الوصية إلى جانب الوكالة الوطنية للعقار السياحي دورا هاما في حماية وتهيئة العقار السياحي، والذي يتم تثمينه عبر الإستثمار أين تلعب الوكالة الجزائرية لترقية الإستثمار عبر شبابيكها المحلية والمركزية الدور الرئيسي في تسيير هذا العقار من خلال توفير التسهيلات وتقديم الإمتيازات للمستثمرين عبر آليات حديثة ورقمية كالمنصة الرقمية للمستثمر لتعزز الشفافية والحد من البيروقراطية، وقد أسهمت الإصلاحات التشريعية في اعتماد صيغة منحهذا العقار عن طريق الإمتياز القابل للتحويل إلى تنازل ومن أجل تحقيق تنمية اقليمية متوازنة وعادلة، أستندت الدولة إلى أدوات التخطيط الوطني والقطاعي كمرجعية لتنظيم استغلال الموارد وتوجيه الإستثمارات بما يضمن التوزيع العادل للمشاريع الإستثمارية وتحسين البنية التحتية كالعمران والخدمات. الكلمات المفتاحية العقار السياحي الوكالة الوطنية للعقار السياحي، الوكالة الجزائرية لترقية الإستثمار الشبابيك المنصة الرقمية للمستثمر ، عقد الإمتياز، المخططات Abstract: Tourism real estate constitutes a fundamental pillar for achieving sustainable tourism development, as it provides opportunities to expand tourism offerings and improve the quality of services. Its development has been accompanied by the modernization of the legal and institutional framework, the simplification of administrative procedures, and the strengthening of legal safeguards to encourage and attract investment, particularly foreign investment. Administrative bodies, led by the supervisory ministry alongside the National Agency for Tourism Real Estate, play a significant role in the protection and development of tourism real estate. This asset is enhanced through investment, with the Algerian Investment Promotion Agency, through its local and central one-stop shops, playing a central role in its management by facilitating investment procedures and granting incentives to investors. This is achieved through modern digital mechanisms, such as the Investor Digital Platform, which promotes transparency and reduces bureaucracy. Legislative reforms have also introduced the system of granting tourism real estate through concession agreements that may subsequently be converted into ownership. To achieve balanced and equitable regional development, the State has relied on national and sectoral planning instruments as a framework for regulating the use of resources and directing investments in a manner that ensures the fair distribution of investment projects and the improvement of infrastructure, including urban development and public services.
