| dc.description.abstract | يتناول هذا البحث موضوع الضبط الإداري الصحي والحريات العامة من خلال دراسة الضبط الإداري من مختلف جوانبه مع التركيز على الصحة العامة باعتبارها أحد أهم عناصر النظام العام ولاسيما بعد الأزمة الصحية العالمية التي أحدثتها جائحة كورونا أين برزت الحاجة الى اتساع سلطات الضبط الإداري وسعيها لحماية الصحة العامة عبر اتخاذ مختلف الإجراءات والتدابير الاستثنائية والضرورية، التي أدت إلى التقييد من بعض الحقوق والحريات الأساسية، مما أعاد طرح إشكالية التوازن بين مقتضيات النظام العام الصحي وصون الحقوق والحريات، بحيث لا يمكن تحقيق هذا التوازن إلا من خلال رسم حدود للنشاط الضبط الإداري، من شئنها أن تكون بمثابة الضمانات القانونية لحماية الحقوق والحريات، وفي مقدمتها مبدأ المشروعية والرقابة القضائية التي تمارس على القرارات المتخذة في هذا الشأن سواء خلال الظروف العادية أو عند الأزمات الصحية. ويؤكد البحث أن هدف حماية الصحة العامة، لا يمكن أن يشكل مبرراً للمساس المطلق بالحقوق والحريات، وانما ينبغي العمل على تحقيق هذا الهدف بشكل متوازن بين الإجراءات الضبطية وحماية الحقوق في إطار قانوني يضمن الضرورة والتناسب. | |
| dc.description.sponsorship | This study examines health administrative control and public freedoms, focusing on public health as a core element of public order, particularly in light of the global COVID-19 crisis. The expansion of administrative powers to protect public health through exceptional and necessary measures has led to restrictions on certain fundamental rights and freedoms, raising the issue of halancing public health requirements with the protection of rights. Achieving this balance requires defining the limits of administrative control, which function as legal safeguards, notably the principle of legality and judicial oversight over decisions, whether in normal circumstances or during health crises. The study asserts that protecting public health cannot justify absolute infringement on rights and freedoms; instead, measures must be applied proportionally and necessarily within a legal framework that ensures both health protection and the safeguarding of rights. | |
