دور إدارة الأوقاف في تفعيل تنمية قطاع الأوقاف في الجزائر

Abstract

تهدف هذه الدراسة إلى إبراز دور إدارة الاوقاف في تفعيل تنمية قطاع الأوقاف في الجزائر وفق دراسة مقارباتية لتجارب دولية، ومن أجل الوصول إلى نتائج هذه الدراسة استخدمنا المنهج الوصفي التحليلي للإطار النظري لهذه الدراسة؛ من خلال إعطاء تصور مفاهيمي عن الوقف، بالإضافة إلى عرض مجموعة من التجارب الدولية الرائدة في مجال الإدارة الوقفية، وكذا التطرق إلى وصف وتحليل واقع قطاع الأوقاف بالجزائر، ومن أجل إبراز دور إدارة الأوقاف على تنمية قطاع الوقف، قمنا بإعداد أداة دراسة ممثلة في استبيان إلكتروني، استهدفنا من خلاله عينة ممثلة في مختصي إدارة الاوقاف بالجزائر على المستوى المركزي و المحلي. ومن أهم النتائج التي توصلنا إليها؛ أن إدارة الأوقاف بمنظور مؤسساتي و تعدد مجالات الاستثمار في الأوقاف تؤثر على التنمية الوقف بأبعاده المختلفة الاقتصادية والاجتماعية والمستدامة بالجزائر، وللنهوض بقطاع الوقف بالجزائر تبرز الحاجة إلى تفعيل آليات التسوية القانونية للوقف، مع ضرورة تعزيز جهود البحث والاسترجاع، مع التوجه نحو توسيع مجالات استثمار الأوقاف خاصة وفق قانون الأوقاف الجديد، مع ضرورة تفعيل دور الديوان الوطني للأوقاف والزكاة كمؤسسة عمومية اقتصادية مستقلة تهدف إلى تسيير وتنمية قطاع الأوقاف بالجزائر، والتوجه أكثر نحو التحول الرقمي في تسيير قطاع الأوقاف، إلى جانب الاستفادة من الخبرات والتجارب الدولية الرائدة في مجال إدارة الأوقاف خاصة من ناحية الاستثمار في قطاع الأوقاف . الكلمات المفتاحية: إدارة الأوقاف، تنمية الأوقاف، الجزائر، تجارب دوليةAbstract This study aims to highlight the role of waqf management in fostering the development of the waqf sector in Algeria through a comparative approach based on international experiences. To achieve the objectives of this research, a descriptiveanalytical method was adopted for the theoretical framework by providing a conceptual overview of waqf, presenting a set of leading international experiences in waqf management, and describing and analyzing the current state of the waqf sector in Algeria. To emphasize the role of waqf management in the development of the sector, a research tool in the form of an electronic questionnaire was designed and administered to a representative sample of waqf management specialists in Algeria at both central and local levels. The main findings reveal that adopting an institutional approach to waqf management, along with diversifying the investment fields of waqf assets, positively influences waqf development in its economic, social, and sustainable dimensions in Algeria. Advancing the waqf sector requires activating legal regularization mechanisms for waqf properties, strengthening efforts in research and recovery, expanding the areas of waqf investment—particularly in accordance with the new waqf law—and reinforcing the role of the National Office of Waqf and Zakat as an independent public economic institution responsible for managing and developing the waqf sector in Algeria. It is also necessary to further promote digital transformation in waqf management and to benefit from leading international experiences, especially in the field of waqf investment.
