آلية الزكاة والوقف لمكافحة مشكلة الفقر في الجزائر

Abstract

الملخص الهدف من هذه الد ا رسة هو إيضاح الدور المهم الذي تلعبه الزكاة و الوقف في مكافحة الفقر في الج ا زئر. الد ا رسة تبين كذلك إمكانية الاستفادة من تجارب مؤسسات الزكاة والوقف في الدول الإسلامية، خاصة فيما يتعلق بالأسلوب الإداري والتنظيمي المتبع في جمع وتوزيع واستثمار أموال الزكاة والوقف لصالح الفق ا رء و المساكين. لذا جاءت إشكالية البحث كمايلي: كيف يمكن أن تساهم مؤسسة الزكاة والوقف في التقليل من مستويات الفقر في الج ا زئر؟ ويرجع سبب اختيار البحث إلى ت ا زيد ظاهرة الفقر رغم كثرة الأموال والب ا رمج والسياسات الموجهة للقضاء على هذه الظاهرة، الأمر الذي يوجب البحث عن آليات مكملة لتلك الب ا رمج الاقتصادية. الد ا رسة انتهت بعدة نتائج أهمها اتساع الفجوة بين حصيلة الزكاة بالج ا زئر وعدد الفق ا رء والمساكين غير المستفيدين خلال فترة الد ا رسة، وهذا ا رجع لضآلة حجم إي ا ردات صندوق الزكاة، كما أن الو ا زرة بذلت عدة مجهودات للنهوض بالأوقاف، وواجهت في ذلك عدة صعوبات منها الجانب التوثيقي، إلا أن هذه المجهودات أعطت ثمارها من خلال اتساع وتنوع الوعاء الاقتصادي للأوقاف، لكن رغم ذلك تبقى إي ا ردات الأوقاف ضئيلة جدا لا تفي حتى بالتكاليف الإدارية للقطاع. وعليها قدمت بعض المقترحات والتوصيات من أجل تحسين دور المؤسستين في الج ا زئر أهمها توفير الإطار القانوني الذي يضمن استقلالية المؤسسات الوقفية والزكوية بعيدا عن تدخل الدولة أو تدخل القطاع العائلي، كما هو الحال في ديوان الزكاة في السودان وبيت الزكاة والأمانة العامة للأوقاف في الكويت.Abstract The aim of this study is to clarify the important role played by Zakat and Waqf in the fight against poverty in Algeria. The study also shows the possibility of benefiting from the experiences of Zakat and Waqf institutions in Islamic countries, especially with regard to administrative and organizational style followed in the collection, distribution and investment of Zakat and Waqf funds in favour of the poor and the needy. As a consequence, the research question is as follows: how can the Zakat and Waqf Foundation contribute to the reduction of poverty levels in Algeria? The reason for choosing to study this topic is the increasing phenomenon of poverty despite the huge amounts of funds, programs and policies geared to eliminate this phenomenon. This situation requires therefore finding complementary mechanisms to those economic programs. The study ended with several results notably the widening gap between the proceeds of Zakat in Algeria and the number of the poor and needy who do not benefit from the Zakat during the study period. In fact this is due to the small size of the Zakat Fund revenues. Although the ministry has made several efforts to promote the Waqf, it has faced several difficulties including the documentation aspect. These efforts have nonetheless been fruitful through the expansion and diversity of the economic base of the Waqf. In spite of this improvement, the monies raised remain very low and do not meet even the minimal administrative costs for the sector. In conclusion some suggestions and recommendations are made to improve the role of these twoinstitutions in Algeria, notably providing the legal framework that ensures the independence of the Zakat and Waqf foundations free from the state interference or the intervention of the household sector, as is the casein the Zakat Office in Sudan, and the Zakat House and the General Secretariat of Awqaf in Kuwait.
