Abstract

من بين أهم المبادئ والقواعد الأساسية في الدستور وقانون الإجراءات الجزائية مبدأ أصل البراءة الذي يعنى أن كل شخص مشتبها فيه كان أو منهما يعتبر بريء مما نسب إليه حتى تثبت جهة قضائية إدانته وفق حكم قضائي بات. وعليه يفرض احترام وتكريس مبدأ أصل البراءة في النطاق الجنائي ضمان تمتع كل شخص يكون في موضع الاشتباء أو الاتهام بارتكاب جريمة ما تمتعه بجميع حقوقه وحرياته الشخصية في مواجهة اجراءات الخصومة الجنائية عبر كافة مراحلها إلى حين ثبوت إدانته وفق حكم قضائي بات في إطار محاكمة عادلة ومنصفة تؤمن له فيها جميع الضمانات اللازمة للدفاع عن نفسه. فضلا عن ذلك يقتضي تكريس مبدأ أصل البراءة إعفاء المتهم من عبده اثبات براءته الثابتة أصلا ويقينا، وعلى من يدعي خلاف هذا الأصل أن يقيم الدليل على ذلك وهو ما يقع على عاتق سلطة الاتهام، وفي هذا الصنت لا يصلح إلا الدليل القاطع المبني على الجزم واليقين التكوين القناعة الوجدانية للقاضي الجنائي، أما مجرد الشك أو الريب فيبقى الأمر على حاله وهو البراءة لأنه ما ثبت بيقين لا يزول. إلا بيقين مثله. وفق هذا المنظور لعل القواعد الإجرائية المقررة للتقصي عن الجرائم ومرتكبيها بهدف ضمان أمن واستقرار المجتمع لا يجب أن تخرج عن نطاق مبدأ أصل البراءة وما يرتبه من نتائج في هذا الصدد، ذلك من خلال تأمين الإجراءات الجنائية بعدد من الضوابط والقيود يراعي فيه المشرع الشرعية الجنائية والتي التزم حدودها السلطات القائمة على العدالة الجنائية بالشكل الذي يضمن براءة الأشخاص أثناء مباشرة الإجراءات الجنائية. The presumption of innocence is one of the most important principles and fundamental rules of the constitution and the Code of Criminal Procedure, It means that every suspect or accused person is considered innocent from charges that has been attributed to him until proven guilty by a judicial authority according to a final court decision. Accordingly, the respect and consecration of the presumption of innocence principle by the criminal institutions guarantees to every person suspected of crime the enjoyment of all his rights and freedoms during litigation proceedings throughout all phases of judgment until proven guilty through a judicial decision based on fair and equitable trial which provides to him the necessary guarantees to defend himself. Furthermore, the presumption of innocence principle requires that the suspect does not have to prove his innocence. So whoever claims the opposite must establish proofs which falls on the authority of the indictment, In this regard, it is not taken into consideration except strong evidence based on certainty to convince the judge. But in case of mere doubt or suspicion, the suspect remains innocent. It is clear that strong evidence can not be opposed only by indisputable evidence In this context, the procedural rules established to investigate crimes and their perpetrators in order to ensure security and stability in the society should not be in opposition to the presumption of innocence principle and its various consequences. Such objective can be achieved by reinforcing the criminal procedures with several restrictions adopted by the legislator to guarantee the innocence of the accused person during the criminal proceedings.
