Abstract
يتميز العقد التجاري المبرم عبر شبكة الأنترنت، بخاصية اللامادية المنبثقة من هذا الفضاء الافتراضي، وهو ما أثار عدة تحديات قانونية لأجل احتواء مسألة تكوينه، خاصة أمام التطور السريع والمستمر للمعلوماتية، ولعل أول تحدي هو ضمان سلامة تحقق إرادة المتعاقدين في هذه البيئة الرقمية ومدى قدرة القوانين على التأمين المعلوماتي لهذا العقد ، خاصة في حال ورود المحل على منتوج رقمي وغير مادي بطبيعته ، وهو ما انبثق عنه عدة اتفاقيات دولية وتشريعات وطنية تعزز هذا التأمين عن طريق إقرار ما يسمى بالتوقيع و التصديق الإلكترونيين، كما يتميز هذا العقد بالطابع الدولي، وهو ما نتج عنه نشأة نزاعات واردة على أركانه أدت إلى بحث القانون الواجب التطبيق و المحكمة المختصة، فضلا عن منح المشرع للمستهلك حق الرجوع عن هذا العقد كحماية إضافية لإرادته باعتباره طرف ضعيف أمام مورد إلكتروني محترف.

certification, and this contract is also characterized by its international character, This resulted in disputes arising over its elements, which led to the examination of the applicable law and the competent court, in addition to the legislator granting the consumer the right to withdraw from this contract as an additional protection for his will as he is a weak party before a professional electronic supplier.
