ضمانات تطبيق القاعدة الدستورية في النظام الدستوري الجزائري

Abstract

يعتبر مبدأ سمو القاعدة الدستورية من أهم المبادئ الأساسية التي تقوم عليها الدولة، لأنه يعكس الإرادة التأسيسية للشعب صاحب السيادة، لذا يفترض احترامه وتطبيقه من طرف جميع مؤسسات الدولة ومكونات المجتمع، لكن النص على هذا المبدأ في وثيقة الدستور وحده غير كاف لتكريس وحماية هذه القاعدة ما لم يحاط بضمانات قانونية مباشرة ممثلة في قيام علاقة تعاون وتوازن متبادلة بين السلطتين التنفيذية والتشريعية، ووجود هيئة للرقابة على دستورية القوانين. كما أن تلك الضمانات القانونية المباشرة قد تصبح عاجزة عن ضمان تطبيق القاعدة الدستورية في ظل تكريس النظام لمبدأ تدرج السلطات بدلا من تعاونها، وهيمنة السلطة التنفيذية وغياب تفعيل آليات الرقابة البرلمانية، وتبعية هيئة الرقابة الدستورية، وتسيس قراراتها خدمة للسلطة السياسية، مما يجعل تطبيق واحترام القاعدة الدستورية يحتاج إلى ضمانات واقعية غير مباشرة ممثلة في رقابة الرأي العام بمختلف أدواته القانونية، وضمانة المقاومة الشعبية السلمية عن طريق وسيلة التظاهر السلمي، تحقيقا لمبدأ سمو الدستور نظريا وعمليا.. Summary: The principle of the supremacy of constitutional rule is considered the most important of the fundamental principles on which the state is based, because it reflects the founding will of the sovereign people, so it is supposed to be respected and applied by all state institutions and the components of society. However, the text of this principle in the constitution alone is not sufficient to establish and protect this rule unless it is surrounded by direct legal guarantees represented in the establishment of a cooperative relationship and mutual balance between executive and legislative branches, and the existence of a body to monitor the constitutionality of laws. Also, these direct legal guarantees may be unable to guarantee the application of constitutional rule in view of the regime's attachment to the principle of hierarchy of powers instead of their cooperation, the predominance of the executive branch, the absence of power activation of parliamentary control mechanisms, the subordination of the constitutional control body and the politicization of its decisions in the service of political power. This means that the application and respect for constitutional rule require realistic indirect guarantees, represented by the control of public opinion with its various legal tools, and a guarantee of peaceful popular resistance through the means of peaceful demonstration, in order to realize the principle of the supremacy of the constitution in theory and in practice.
