Abstract

Real estate cultural property is of great importance in proving the national and historical identity of any people, as it expresses its history and originality as tangible material evidence that has remained steadfast since the prehistoric era to the present day, in addition to its importance from the social, cultural and economic point of view. These properties are currently a source of economic development in addition to their symbolic and identifiable characteristics, as evidenced by the fact that many countries that possess this cultural heritage rely on it mainly in the development of their economy, as they exploited their real estate cultural wealth in the tourism process, as they constitute the raw material for the tourism industry, and represent A significant resource in revitalizing heritage tourism, because it is one of the most important tourist attractions, as it contributes to bringing tourists to archaeological sites and monuments, in order to get acquainted with the most important archaeological monuments that silently tell the stories and secrets of ancient civilizations, as well as for hiking, entertainment and recreation. This leads to an increase in the sources of national income that contributes to sustainable economic development, including the improvement of the standard of living of individuals, and this will only be achieved by exploiting this cultural stock and valuing it by rehabilitating monuments and archaeological sites to attract tourists, and this will lead to the development of cultural tourism.
That is why the legislator has given it great attention from the outset, and this is evident through the enactment of a special law that governs it, which is Law No. 98-04 related to the protection of cultural heritage, in addition to laws that include general principles and provisions, as they are real property such as the Civil Law, the Real Estate Orientation Law, and the Law of Real Estate. National property and endowment law. In view of its ownership system, it is subject, in terms of its operation and protection, to the same legal provisions to which other real estate properties are subject, depending on its nature and the class to which it belongs. Its legal nature is divided into the three legal categories stipulated in Article 23 of the Real Estate Guidance Law, that is, it may be public property, private property, or endowment property, but it seems that the legislator tends to extend the state's dominance over this type of property to make it national property as a principle, and that By the legal means mentioned in Law 98-04, in order to preserve this property from loss and extinction, if it were left in the hands of individuals.
It should be noted that Law 98-04, mentioned above, came with many legal mechanisms, including subjecting real cultural property, whatever its legal status, to one of the protection systems, represented by registration in the additional inventory list, classification, creation in the form of preserved sectors, increase Accordingly, the state maintains other mechanisms such as registration in the general inventory list, and the legislator relied on other means of protection by merging cultural real estate belonging to protected private ownership into public property belonging to the state through amicable.... means represented by a consensual purchase contract, exchange and donation contract, or through compulsory methods that It is represented in the expropriation of property for the public benefit and the exercise of the right of administrative pre-emption, while the state reserves the right to enact administrative easements for the public interest. All these mechanisms were enacted in order to provide effective protection for this type of ownership.
In addition to all this, the legislator enacted a set of penal texts to combat the various forms of assault on this type of property, which would lead to prejudice, loss and extinction.
Despite the availability of many public and private legal mechanisms to confer protection on these properties, unfortunately, the reality proves that real estate cultural property is witnessing a great state of deterioration, due to repeated assaults, either out of negligence or ignorance of its importance as a historical and economic cause at the same time, as it is a resource It is not negligible in developing tourism and bringing tourists to see and learn about the historical monuments and archaeological sites that abound in our country.
