الحماية الجزائية للأسرة من الجريمة الإلكترونية أطروحة

Abstract

"تتضمن هذه الدراسة مدى توفير المشرع الجزائري الحماية الجنائية للأسرة من الجريمة الإلكترونية، وهل الآليات القضائية وغير القضائية كفيلة بالتصدي لهذا النوع المستحدث من الجرائم الواقعة على الأسرة، والتي تشكل خطراً حقيقياً بالنظر لخصوصية الجريمة الإلكترونية وما يترتب عنها من أضرار نفسية كبيرة وتهديد حقيقي لها، لاسيما أنها تطال كل أفراد الأسرة (الزوجين والأبناء)؛ فقد ترتكب من فرد من أفرادها على أحد أفرادها، وقد ترتكب من الغير. كما تتضمن الدراسة كذلك مدى نجاعة النصوص القانونية التقليدية الحالية، سواء كانت نصوصاً عامة أو خاصة، في توفير حماية للأسرة. الكلمات المفتاحية: الحماية الجنائية، الأسرة، الجريمة الإلكترونية."

This study includes the extent which the Algerian legislator provides protection for the family from cybercrime, and the capacity of the judicial and non-judicial mechanisms adressing this type of crime, which poses a real danger in view of the specificities of cybercrime and the consequent of psychological damage and the real rift for the family, especially because any one of its memebers can be a victime, no matter were the parents or their children. This study also included the effectiveness of the current traditional legal texts, whether general or private, in providing protection for the family.
