Abstract
Summary:
The elderly category in Algerian legislation, as well as international instruments, has enjoyed special legal protection, through the issuance of Law No. 10-12 on the Protection of Elderly Persons, which was a strong support for other branches of law that dealt with the protection of this group in various aspects.
The Algerian legislator has protected this fragile group by defining a set of rights, such as social rights and economic rights, in order to live a calm and comfortable life, and between the legal frameworks that enjoy these rights in their constituency, the most important of which are the family, society and the relevant state institutions.
In order to achieve this desired legal protection, the Algerian legislator took two paths, the first of which is the criminal mechanism, both substantive and procedural, and the second is civil, in its substantive and procedural forms as well. This is all in order to ensure effective protection and to pay for all kinds of neglect, discrimination and marginalization that may be practiced against the elderly by society, individuals and institutions.
