Abstract

Summary: A patent represents one of the industrial property rights, which is a part of intellectual property rights in general, and it is the basis of invention, as it is the basis of technological development and the wealth scale of nations. Due to this importance, inventors have received legal protection by national legislation by establishing laws that protect the patent, as it was not limited to internal laws, but it went beyond these countries to become international. The first agreement to preserve industrial property was the Paris Convention in 1883, then international agreements for patent protection followed, some of them are specialized and others are general. Until the TRIPS Agreement appeared in 1994, which expanded the scope of patent protection, it granted exclusive rights to their owners, which was not covered by previous agreements. In our study, we dealt with this international and national protection, which led us to question its efficiency in light of the globalization of intellectual property rights, especially when the gap between developing and developed countries are increasing and exactly after the TRIPS Agreement, when it came up with new provisions to conserve the patent of invention, which although ostensibly serving developing countries, on the contrary, came in favor of developed countries. It seems that the TRIPS Agreement is more commercial than protectionist. And to answer this question, we have talked about this patent protection before the TRIPS Agreement by examining the agreements that preceded it. Then we discussed the protection developments brought about by the TRIPS Agreement and its impact on developing countries
