Abstract

The study addressed two fundamental issues, namely, the jurisdiction of the International Criminal Court, the application of rules for the protection of prisoners, which entails determining what rules for the protection of prisoners are rules of international humanitarian law and the rules of the law of war, and then discussing and analysing the substantive jurisdiction of the International Criminal Court and the law it applies, indicating the correlation between the nature of violations of the rules of prisoners of war and the extent to which they are considered crimes of international concern defined as war crimes within the jurisdiction of the International Criminal Court, and the Court. In this regard, the Court should, in accordance with its Statute, apply the relevant rules of international humanitarian law and the law of war, and finally, deal with the problems relating to the operation of the jurisdiction of the Court in terms of the attribution of jurisdiction to the Court and the power of the States concerned and the Security Council to defer or delay the exercise of jurisdiction by the Court in this regard.
