Abstract

من خلال موضوعنا سلطنا الضوء على الضبط الإداري في مواجهة الظروف الإستثنائية لَسيما جائحة كورونا التي ترتبت عليها عدة آثار شملت كل الميادين، إذ أصبحت تهدد جميع دول العالم نظار للمخاطر الناجمة عن هذا الفيروس القاتل الذي لَ يعرف حدود له بسرعة تفشيه من دولة إلى أخرى، وذلك ارجع لعدم تشخيصه وحتى مدة بقائه، ولخطورة هذا الوضع الإستثنائي ولمواجهته عملت السلطات على الحد منه ومنع انتشاره، إلَ أنهونظار لمحدودية الإمكانيات في المجال الصحي تم اللجوء إلى تدابير ح اءات وقائية تحقق الصال جر ا و العام؛ ومادام هذا الظرف الإستثنائي مرتبط بعنصر الصحة فهو يعد مفهوما جديدا لمصطلح الطوارئ الصحية، وهذه الحالة الإستثنائية الجديدة جاءت كضرورة حتمية استثنائية لوضع نظام قانوني يكفل إعادة الأوضاع إلى حالتها العاديةالذي شكل تقييدا جزئيا مؤقتا على بعض الحقوق والحريات. الكلمات المفتاحية: سلطات الضبط الإداري، جائحة كورونا، الظرف الإستثنائي، الطوارئ الصحية، تدابير، إجارءات. Abstract Through our topic, we shed light on the administrative control in the face of exceptional circumstances, especially the Corona Pandemic, which resulted a several effects that included all fields.As it has becom a threat to all countries of the world from the dangers resulting by the deadly virus that did not knowen borders, due to its rapid spread from one country to another, and the failure on diagnose it even its duration, and due to the seriousness of this exceptional situation and to confront it, the authorities resorted tolimiting it and preventing its spread, as it became impossible with the limited capabilities in the health field, resorting to preventive measures and procedures that achieve the public interest, as long as this exceptional circumstance is linked to the health element, it is a new concept for the term health emergency, and this new exceptional situation came as anexceptional imperative necessity to establish an existing legal system capable of returning things to their normal state, which constituted a temporary partial restriction on some rights and freedoms.
