دور القضاء في الإشراف والرقابة على العملية الانتخابية

Abstract

تعد مشاركه الأفراد في الحياة السياسية عن طريق الانتخاب من الحقوق السياسية التي سعت الدول إلى ترسيمها على المستويين الداخلي والدولي، فأصبح الوسيلة الوحيدة التي تعتمد عليها الدول في إسناد السلطة، عن طريق منح الحق لشعوبها في إدارة شؤونه العامة، مما يستدعي إحاطته بالضمانات الكفيلة والكافية حتى تكون نتائجه معبره تعبيرا حقيقيا عن إرادته. إن الانتخاب لا يتوقف عند تلك المرحلة التي يتم فيها وضع الناخب الظرف في الصندوق وينسحب، بل هي عبارة عن مراحل مركبه ومرتبطة ببعضها البعض تبدأ بإعداد الهيئة الناخبة إلى غاية إعلان النتائج، والتي قد تثير في كل مرة جدلا ونقاشا حول نزاهتها من عدمها، نظرا لما يتخللها من أفعال الغش والتزوير، مما يستدعي فرض حماية على جميع مراحلها عن طريق القضاء الذي يعتبر من أفضل الضمانات، حيث يتدخل عن طريق الإشراف والرقابة على مراحل العملية الانتخابية لضمان سيرها وفقا لما ينص عليه قانون في كل من فرنسا ومصر والجزائر، وهذا لتحقيق نتائج انتخابية معبرة عن الإرادة الحقيقية للشعب. Abstract The participation by individuals in political life through election is one of the political rights that States have sought to demarcate at the domestic and international levels, becoming the only means on which States rely to assign power, by granting their peoples the right to run their public affairs, which requires that they be given sufficiant guarantees so that its results can be the right expression of their will. The election does not stop at that stage when the envelope voter is placed in the box and withdraws. Rather, they are complex and interrelated phases that begin with the preparation of the elective body until the results are announced, Which may, at a time, spark debate about their integrity. The protection of all stages through the judiciary, which is considered one of the best guarantees ". In which it intervenes through supervision and oversight of the stages of the electoral process in order to ensure that they proceed in accordance with the provisions of law in France, Egypt and Algeria, to achieve electoral results that reflect the true will of the people.
