Abstract
Abstract
The expansion in the volume of electronic commerce has led to a dramatic increase in litigation and problems arising from it, due to the physical absence of customers at the time of entering into their commercial contracts, the subject of the dispute being subject to different jurisdictions, as well as the conflict of applicable laws, which has led to the search for more suitable means to resolve disputes in electronic commerce, the most important of which is electronic arbitration.
The subject of the thesis is the study of the legal regime of electronic arbitration in electronic commerce, it was treated in two parts: The first concerns: The impact of electronic means on the arbitration system, becoming electronic arbitration, in terms of its substantive and procedural framework, and how technique affects all stages of electronic arbitration.
The second concerned the capacity of the current legal regime governing arbitration to adapt to electronic arbitration, and whether, through the various sporadic national and international legal frameworks and systems relating to electronic arbitration, a comprehensive legal regime for electronic arbitration could be developed.
The novelty of the subject of electronic arbitration, the variety of its stages and procedures, from the electronic arbitration agreement to the presentation of the request for arbitration through the arbitration procedure until the conclusion of the electronic arbitration judgment, requires a complex scientific approach, based on description, analysis and comparison.
We have found that electronic arbitration shares its substance, provisions and procedures with traditional arbitration, but differs from the environment in which it operates, since electronic arbitration takes place in an environment characterized by a new specificity, the use of modern technology or, in other words, electronic media. This environment demands that this arbitration be characterized by a new character different from arbitration in its traditional aspect.
The COVID-19 pandemic over the past two years has also resulted in the increasing use of virtual dispute resolution mechanisms around the world. This wave prompted DSA service providers to quickly adapt their practices to the digital context, and traditional arbitration institutions like the American Arbitration Society, the International Chamber of Commerce and others facilitated the transition from arbitration, traditional to digital or electronicarbitration by modifying various protocols, rules and procedures governing arbitration. International organizations are called upon to promote the possibilities of cooperation between legislators in order to promote the adoption of an international convention governing the provisions relating to electronic arbitration, as is the case with the New York Convention of 1958, in with a view to establishing a uniform legal regime.
The Algerian legislator, in the era of the digitization of the administration, recognized the electronic signature and the certification; a law on electronic commerce was promulgated in 2018. But in order to complete the legislative framework relating to the field of digitization, the legislator is called upon to issue a text relating to electronic arbitration, as the French legislator did in 2019, where he referred to electronic arbitration within the framework of the provisions of the law reforming the justice system, and also issued a decree for the accreditation procedures of electronic arbitration bodies, in the year 2020.
