Abstract

تكمن الحماية الدولية للاجئين أساسا في اتخاذ العديد من الإجراءات العامة التي تمارسها الأجهزة المختصة في الأمم المتحدة أو ما تمارسها أجهزة الحماية الدولية الخاصة المسؤولة عن مراقبة احترام حقوق الإنسان والتي أنشئت بموجب اتفاقيات الوكالات الدولية المتخصصة التي تلت إنشاء منظمة الأمم المتحدة. لقد صاغت الأمم المتحدة مجموعة كبيرة من الاتفاقيات والأعراف الدولية التي تحمي اللاجئ وتحافظ على حقوق الإنسان، وكانت الاتفاقية الدولية الخاصة بمركز اللاجئين والصادرة عام 1951 من أهم الاتفاقيات الدولية التي صدرت بعد الحرب العالمية الثانية. إن تناول موضوع تناول الحماية الدولية للاجئين من خلال بيان مركزهم القانوني بما لهم من حقوق وما يترتب عليهم من التزامات، ورصد الممارسات الدولية المتعلقة بهذا الموضوع، وتحليلها لمعرفة مدى مشروعيتها، مع بحث مسألة انتهاء الحماية الدولية للاجئ عند قيامه ببعض التصرفات، وذلك من أجل إيجاد حالة من التوازن بين حماية اللاجئين وبين حاجة الدول للمحافظة على أمنها وسلامتها، وحسن علاقاتها مع الدول الأخرى. La protection internationale des réfugiés réside principalement dans les nombreuses actions prises par les organes compétents des Nations Unies ou les organismes spéciaux de protection internationale qui veillent au respect des droits établis en vertu des conventions des institutions internationales spécialisées qui ont suivi l' émergence de l'organisation des Nations Unies. L'ONU a adopté un large éventail de conventions et de normes internationales qui protègent les réfugiés et préservent leurs droits. A ce titre, la Convention internationale relative au statut des réfugiés de 1951 est l'une des plus importantes conventions qui ont été promulguées après la seconde guerre mondiale. Nous abordons la question de la protection internationale des réfugiés en indiquant leur statut juridique ainsi que leurs droits et obligations. Dans ce cadre, nous analysons les pratiques internationales qui se rapportent au sujet de la protection des refugies en précisant sa qualification vis-à-vis du droit international. Aussi, nous discutons dans quel cas cette protection est exclut spécialement dans le cadre de certaines actions. L'objectif de ces démarches c'est de créer un équilibre entre la protection des réfugiés et le maintenir la sécurité et l'intégrité des Etats et d'améliorer les relations ente eux. The international protection of refugees resides mainly in the numerous actions taken by the competent organs of the United Nations or the special organizations of international protection which ensure respect for the rights established by virtue of the conventions of the specialized international institutions which have followed the emergence of the United Nations organization. The UN has adopted a wide range of international conventions and standards that protect refugees and uphold their rights. As such, the International Convention relating to the Status of Refugees of 1951 is one of the most important conventions that were promulgated after the Second World War. We address the question of the international protection of refugees by indicating their legal status as well as their rights and obligations. In this context, we analyze the international practices that relate to the subject of refugee protection by specifying its qualification vis-à-vis international law. Also, we discuss in which case this protection is excluded especially within the framework of certain actions. The objective of these steps is to create a balance between the protection of refugees and the maintenance of the security and integrity of States and to improve relations between them.
