آثار الاتفاقيات الدولية على إنشاء الرابطة الزوجية وانحلالها من خلال قانون الأسرة الجزائري

Abstract

الملخص تعتبر الأسرة البنية المكونة للمجتمع والدولة ككل، ولما لهذه الأخيرة من أهمية بالغة في المجتمع فقد أولتها الشريعة الإسلامية العناية والرعاية الكبيرة. كما أن المجتمع الدولي حاول مواكبة العصرنة وذلك من خلال تضافر جهوده وسعيه التنظيم حقوق الأفراد في المجتمع فقد قام بإصدار مجموعة من الاتفاقيات المتعلقة بحقوق الانسان، وعلى اثرها سارعت حل التشريعات الدولية إلى اضفاتها على قانونها الداخلي، خاصة منها تلك القوانين المتعلقة بالأسرة، وهذا على غرار المشرع الجزائري الذي حاول تكريس بنود تلك الاتفاقيات التي قام بالمصادقة عليها على قانون الأسرة سعيا منه التحقيق مبدأ المساواة الذي كرسته تلك الاتفاقيات خاصة منها في المواد المتعلقة بالزواج والطلاق، بذلا جهده التوفيق بين المرجعية الدينية والدولية القانون الأسرة الجزائري. حيث أنه قام بوضع تحفظات على مجموعة من البنود التي تتعارض مع أحكام الشريعة الإسلامية. والجدير بالذكر أن حل تلك الاتفاقيات ترمي إلى تحقيق المساواة بين الجنسين في مختلف المجالات. ومن بينها الأمور المتعلقة بالأسرة، فحاول المشرع الجزائري تجسيد بنود الاتفاقيات الدولية التي صادق عليها سواء من خلال سنه القانون الأسرة رقم 84-11، أو عند قيامه بتعديله بموجب الأمر 05-02 وذلك بإدراج مجموعة من الاحكام التي ترمي إلى تحقيق مبدأ المساواة بين الجنسين في الأمور المتعلقة بالحياة الأسرية، خصوصا تلك الأمور المتعلقة بمسائل الزواج والطلاق فتجده وقف وقفة متدينية بين الأخذ بالمرجعية الدينية أو الدولية نتيجة تعرضه ربما لضغوطات خارجية، حيث حاول تحقيق المقاربة التوفيقية بين المرجعية الدينية والدولية لقانون الأسرة، سعيا منه لتحقيق مبدأ المساواة بين الجنسين، وما يمكننا قوله أن الاتفاقيات الدولية قد حققت لنا المساواة بين الجنسين، غير أنه الشريعة الإسلامية قد حققت لنا العدالة بين جميع الناس.

Abstract: The family is the constituent structure of society and the state as a whole, and because of its importance in society, Islamic law has given it great care and care. The international community has tried to keep abreast of modernization by combining its efforts and efforts to regulate the rights of individuals in society. It has issued a number of human rights conventions. This is in line with the Algerian legislator, who tried to enshrine the provisions of those conventions which he ratified on the family law in an attempt to achieve the principle of equality enshrined in those conventions, especially in the articles Relating to marriage and divorce, in an effort to reconcile the religious and international reference to Algerian family law. As he has placed reservations on a range of items that are contrary to the provisions of Islamic law. It is worth mentioning that most of these agreements aim to achieve gender equality in various fields, including family matters. The Algerian legislator attempted to reflect the provisions of the international conventions that he had ratified, both through his enactment of Family Law No. 84-11, By including a set of provisions aimed at achieving the principle of gender equality in matters relating to family life, particularly those relating to matters of marriage and divorce, we find it necessary to stop a volatile stand between the adoption of religious or international reference as a result of external pressures. A compromise between the religious and international reference to family law, in an attempt to achieve the principle of gender equality, and what we can say that international conventions have achieved us equality between the sexes, but Islamic law has brought us justice among all people
