Abstract

يشكل مركز فلسطين في القانون الدولي حالة فريدة بالنظر للتطورات العديدة التي مر بها، والتي أثرت بشكل مباشر على إمكانية فتح تحقيق رسمي جنائي على الأراضي الفلسطينية المحتلة ، لأن الإشكال الذي اعترض ذلك هو مدى اعتبار فلسطين "دولة " بموجب نظام روما الأساسي، ليبقى الأمر معلقا على إصدار الدائرة التمهيدية للمحكمة قرارا يتضمن فتح التحقيق، وهو ما سينعكس إيجابيا على الأفعال المرتكبة بحق الفلسطينيين إذ أن التحقيق سيعطيها الوصف القانوني الملائم لها ، بما أن الأفعال التي ذكرها الباحث في هذه المذكرة كيفها بمجهود شخصي انطلاقا من نصوص النظام الأساسي للمحكمة الجنائية الدولية Abstract The status of Palestine in international law is a unique case in view of the many developments it has undergone, which have directly affected the possibility of opening a formal criminal investigation into the occupied Palestinian territories, because the forms that have challenged this are the extent to which Palestine is considered a "State" under the Rome Statute. To keep the matter pending a decision by the Pre-Trial Chamber of the Court that includes opening the investigation, which will have a positive effect on the acts committed against the Palestinians, as the investigation will give it a proper legal description. Since the acts mentioned by the researcher in this memorandum, they are individually adapted from the provisions of the Statute of the International Criminal Court. .
