Abstract

"تبرز السلطة التقديرية في المجال التأديبي للإدارة باعتبارها أحد أهم الامتيازات القانونية وضرورة لضمان الفاعلية الإدارية وحسن سير المرفق العام تحقيقاً للمصلحة العامة، بصفة خاصة في تكييف الخطأ المهني واختيار العقوبة، نظراً لعدم وجود قواعد قانونية تحدد حصراً كافة الأخطاء المهنية، وهو ما يحتمل إمكانية تعسف سلطة التأديب. ولكن اعتراف القانون للإدارة بهذا الامتياز لا يعني أنها سلطة مطلقة، وإنما يتعين عليها أن تمارسها في إطار مبدأ الشرعية الذي يلزم الإدارة باحترام قواعد التأديب مهما كانت درجتها، بهدف توفير أقصى الضمانات للموظف لحمايته من تعسف الإدارة. وعليه، تهدف هذه الدراسة إلى إبراز الدور الهام لمبدأ الشرعية في تقييد السلطة التقديرية للإدارة في تأديب الموظف، ومدى تأثير ذلك على كفالة الضمانات التأديبية وتحقيق الحماية القانونية للموظف العام."

The Department's disciplinary discretion stands out as one of the most important legal privileges as a need to ensure the administrative effectiveness and proper functioning of the General Facility in the public interest, in particular in adapting professional error and selecting punishment, since there are no legal rules that specify exclusively all professional errors and this is likely to be arbitrary. But the law's recognition of the administration of this privilege does not mean that it is an absolute authority but must exercise it under the principle of legality, which obliges the administration to respect disciplinary rules of whatever degree in order to provide the staff member with the utmost safeguards to protect him from the arbitrariness of the administration, This study therefore aims to highlight the important role of the principle of legality in restricting management's discretion in disciplining a staff member and the extent to which this affects ensuring disciplinary safeguards and the legal protection of a public official.
