Abstract
اهتمت الشريعة الإسلامية بالنسب اهتماما بالغا فجعلت حفظ النسل مقصدا من مقاصدها الكلية الضرورية فكانت متشوفة إلى اتصال الأنساب وعدم اختلاطها ، فكما حرصت على إثبات النسب، و حرصت أيضا على نفيه حيث لا مجال لإثباته، وذلك كلما قامت الدلائل النافية له وهذا من باب الاحتياط للأنساب، ولا ينفى النسب إلا بإجراء اللعان.
و في السابق كانت هناك حقائق إذا تعارض معها النسب انتقى، كالولادة لأقل مدة الحمل أو أقصاها، أو إذا كان الزوج فاقدا لأهلية الإنجاب، أو إذا ثبت عدم التلاقي بين الزوجين.
أما في الوقت الحاضر وفي ظل الاكتشافات العلمية، أصبحت مسألة الطرق العلمية (تحليل فصائل الدم - البصمة الوراثية ) من القضايا المستجدة والتي يمكن الاعتماد عليها في مجال نفي النسب، رغم اختلاف الفقهاء المعاصرين في مدى حجيتها في نفي النسب ومدى تعارضها مع اللعان باعتباره الوسيلة الشرعية والقانونية المتفق عليها لنفي النسب بالاضافة الى العقبات القانونية التي أمامها .
Description
The Islamic Shariaa paid great attention to lineage, and made the preservation of the offspring one of its total purposes, so it was concerned about the connection of lineages and not mixing them. Just as I was keen to prove the lineage, I was also keen to deny it as there is no room for its proof, and this whenever the evidence that negates it is established and this is a matter of precaution for lineage, and it is not hidden Descent, except by making curse.
In the past, there were facts that if the lineage contradicts it, it is negated, such as giving birth to the least or maximum period of pregnancy, or if the husband lacks the capacity to have children, or if the lack of convergence between the spouses is transmitted.
At the present time and in light of scientific discoveries analysis of blood groups, genetic fingerprinting emerging issues that can be relied upon in the field of denial of lineage, despite the differences of contemporary jurists regarding the extent of its validity in the denial of lineage and the extent of its conflict with curse as the legitimate and legal means of denying lineage Proportions.
