الحجر القضائي في الفقه الإسلامي والقانون الجزائري

Abstract

ينظم الحجر القضائي في القانون الجزائري كل من القانون المدني وقانون الأسرة، ويعبر عن الحجر بالمنع الذي يطال تصرفات الشخص المالية، إذا ما قام به عارض من عوارض الأهلية بعد بلوغه سن الرشد، ينقص أهلية أدائه أو تعدمها وقد تضمن القانون المدني تعدادا لعوارض الأهلية على سبيل الحصر وهي: الجنون والعته والسفه والغفلة، ولم يدرج قانون الأسرة عارض الغفلة ضمن عوارض الأهلية، والذي يعتبره فقهاء الشريعة الإسلامية صورة لعارض السفه، مما يثير إشكالا أي القانونيين أولى بالتطبيق، وقد درج فقهاء القانون على تسمية الحجر بالمعنى السابق بالحجر القضائي تمييز له عن الحجر القانوني الذي يوقع على الجاني في جناية كعقوبة تكميلية بمناسبة تنفيذ العقوبه الأصليه. وقد أخذ المشرع الجزائري برأي فقهاء القانون بوجوب توقيع الحجر ورفعه يحكم قضائي أيا كان سبب توقيعه، وعلى خلاف جمهور فقهاء الشريعة الإسلامية خاصة بالنسبة للمجنون الذي لا يستوجب حكم الحاكم لتوقيع الحجر عليه. ...this... The judicial quarantine in the Algerian law regulates both of the civil law and the family law, and expresses the prohibition of the quarantine for the one who affects the person's financial actions if he performs one of the eligibility symptoms after reaching adulthood, the eligibility of his performance will be executed, and the civil law may include listing the eligibility symptoms restrictions insanity, dementia, foolishness and negligence are among the symptoms of eligibility, which islamic jurists consider as a picture of the foolish exhibitor, that raises a confusing problematic of which laws mustbe appleid, and jurists have used the practice of naming the quarantine in the previons sense as a judicial quarantine, in order to distinguish it from the legal quarantine that is signed on the perpetrator in a felony as a complementary punishmant on the occacion of the enforcement of the original punishment. The Algerian legislator has taken the opinion of jurists that the quarantine should be signed and lifted by a judicial ruling, whatever the reason for signing it, and unlike the majority of islamic jurists, especially for the madman who does not require the ruling of the ruler to sign the quarantine.

Résumé L'interdiction judiciaire est régie selon la législation algérienne autant par le droit civil que par le droit de la famille, elle consiste dans l'empêchement qui affecte les actes financières de la personne majeur, la capacité se trouve alors réduite ou annulée, le code civil a énuméré exclusivement les causes d'incapacité: la démence I'mbécilité; la prodigalité et la sujette, le code de la famille n'y a pas intégré l'état d'imbécilité qui est coneidéré comme une variante de la prodigalité chez la doctrine musulmane, ce qui soulève une difficulté pour savoir quelle loi doit être appliquée en premier. La jurisprudence s'est habituée avec l'appellation d'interdiction au sens d'interdiction judiciaire en distinction de l'interdiction, légale prononcée à l'égard de l'auteur d'un crime en tant que peine accessoire en exécution de la peine principale. Le législateur algerien a consacré l'opinion de la jurisprudence qui exige que la prononcée de l'interdiction et sa levée interviennent en vertu d'une décision de justice quelque soit la cause du prononcé, cotrairement à la doctrine musulmane surtout par rapport à la démence qui n'exige pas la décision de juge pout interdire la personne.
