Abstract
ان التطور الحاصل في المنظومة القانونية الدولية لحقوق الانسان كان له الانعكا الايجابي على الحماية القانونية الدولية لحقوق السجناء و يتجلى ذلك من خلال الاعتراف الصريح أن الهدف من العقوبة في السياسات العقابية الحديثة لم يعد انتقاما من المجرم والتنكيل به بل العمل على اصلاحه و اعادة تأهيله وإعادته موطنا صالحا في مجتمعه، فتظاهرت الجهود لإقرار منظومة قانونية دولية تكرس بشكل صريح حقوق هذه الفئة ونتيجة لذلك تم الاعتراف الصريح بإنسانية وأدمية المسجون وقد ترتب على هذه الأخيرة ضرورة التعامل معه بإنسانية و ذلك بضمان حد أدنى من حقوق الانسان له لا سيما الأساسية منها بما يتوافق وحالة الاحتجاز.
و قد كان للأمم المتحدة كراع رسمي لحقوق الانسان و حقوق السجناء خصوصا بالإضافة إلى الدور الفعال للمنظمات غير الحكومية في اقرار تلك المنظومة القانونية والسهر والسعي إلى تطبيقها في أرض الواقع في ظل كل المشاكل التي تعاني منها السجون في مختلف دول العالم والأوضاع التي كثيرا ما لا تتفق مع المعايير الدولية في مجال حماية حقوق السجناء رغم الجهود الوطنية المبذولة في هذا المجال.
