منازعات الحدود الدولية وأدلة الإثبات

Abstract

تشكل منازعات ابغدود الدولية ابعزء الأكبر من ابؼنازعات الدولية الراىنة، البٍ تساىم في توتر العلبقات ببْ الدوؿ ابؼتجاورة ، خصوصا بعد التطورات البٍ يشهدىا المجتمع الدولر في نهاية القرف 19 وبداية القرف 20 ، وفي مثل ىذه ابؼنازعات تلجأ الأطراؼ ابؼتنازعة إلذ الوسائل السلمية للحصوؿ على حل سلمي ونهائي، لصالح الطرؼ الذي يقد الأدلة القانونية ذات القيمة الثبوتية القاطعة، ومنع نشوب نزاع مسلح يهدد السلم والأمن الدوليبْ، وماينجم عنو من تبعات سياسية وقانونية تؤثر على بـتلف المجالات "السياسية والاقتصادية والاجتماعية " ببْ طرفي النزاع. بودد موضوع دراستنا ابؼتعلقبمُ نازعات ابغدود الدولية وأدلة الإثبات الطبيعة القانونية بؽا،ويتعرض إلذ ابؼميزات البٍ تنفرد بها عن بقية ابؼنازعات الدولية الأخرى وخاصة الإقليمية منها، ويُ برِز أىم أسباب نشأتها وبذددىا رغم تسويتها بطرؽ سلمية، وعلى ىذا الأساس تطرقنا إلذ التعمق في دراسة أدلة إثبات ابغق ابؼعتمدة في حل ىذه ابؼنازعات أما ا﵀اكم الدولية. وبسحورت الاشكالية الرئيسية ابؼطروحة في دراستنا حوؿ فاعلية وبقاعة دور ىذه الأدلة في إثبات ابغق، وتوفيقها أو بقاحها في حل منازعات ابغدود الدولية بشكل نهائي، وط رِحت ىذه الاشكالية كنتيجة حتمية لاختلبؼ موقف ا﵀اكم الدولية من برديد القيمة القانونية بؽذه الأدلة. ولتوضيح الرؤيا أكثر قمنا بإستعراض بعض قضايا منازعات ابغدود الدولية البٍ عرضت أما ا﵀اكم الدولية قصد معرفة موقفها من القيمة القانونية للؤدلة ابؼطبقة في ىذه ابؼنازعات، وبرديد الأسباب ابغقيقية وراء استمرا رىا وبذددىا، واف كاف مردىا إلذ عد فعالية ىذهInternational border disputes constitute the most Significant part of current internationaldisputes,which contribute to thetension in relations between neighbouring countries, especially after the developments witnessedby the international community at the end of the 19th century and the beginning of the 20th century, in such disputes , the partiesresort to peaceful meansto obtain a peaceful and final solution in favour of the party that presents thelegal evidence which conclusive proof value , Preventing the outbreak of an armedconflict that threatens international peace and security, and the resulting political and legal consequences that affect variousFields “political, economic and social” between the two parties to the conflict. Our study topic focuses on international border disputesand the Legal nature of the evidence used in them,it addresses the features distinguishing them from other international conflicts,especially regional ones, it highlight the main reasons fot their emergence and renewal despite their settlement through peaceful Means, based on this , we delved into the study of the evidence of proof ofright adopted in resolvingthese disputes before international courts. The main problemraised in our study revolved around the effectiveness and efficiency of the role of thisevidence in Proving the right and reconciling orsucceeding in resolving international border disputes permanetly , this problem was an inevitable result of the differing positions of Internationnal courts to determining the legal value of this evidence. The clarify the vision further , we reviewed some cases of international border disputes presented beforeinternational courts to learn their positions on the legal value of the evidence applied in these disputes,determine the real reasons behind their continuation and renewal , and whether it is due ineffectiveness of this evidence or other considerations. الأدلة أ إلذ اعتبارات أخرى.
