Abstract

تمتاز فلسطين ببيئة غنية سخية وبتنوع في النبات والحيوان والمعالم الجيولوجية والجغرافية لا يجد المرء له مثيلا في بلدان العالم الأخرى ذات المساحة المقاربة، ونحن الآن في وقوفنا على عتبة بناء الدولة الفلسطينية مدعوون الى معالجة شؤون البيئة الحاضرة والمستقبلة بوعي واهتمام. وقد اهتم القانون الدولي بالبيئة اهتماماً كبيراً وأولاها عناية خاصة، كما أولى المشرع الفلسطيني للبيئة حماية خاصة، سواء البيئة المائية أو البيئة الهوائية أو الأرضية، حيث وضع أدوات قانونية وإدارية لحمايتها، كما فرض عقوبات مدنية وجزائية على مرتكب أفعال تلويث البيئة، واعتبر أن المعاهدات الدولية التي تصادق عليها فلسطين في شأن البيئة ملزمة وواجبة الإتباع. الكلمات المفتاحية حماية البيئة المشرع الفلسطيني، القانون الدولي للبيئة التلوث البيئي، المسؤولية القانونية عن الأضرار البيئية. Abstract Palestine is characterized by a rich environment and a diversity of plants, animals geological and geographical features that one doesn't find in other countries with similar spaces. From this point and as long as we stand on the threshold of building the Palestinian state, we are called upon to deal with current and future environmental issues with awareness and interest. In this regard, international law has paid great and special attention to the environment. The Palestinian legislator, as well, has given special attention and protection to water, air, and earth. That is, it's developed legal and administrative tools to protect them and imposed civil and criminal penalties on the perpetrator of environmental pollution acts. The legislator has also considered that international treaties ratified by Palestine regarding the environment are binding and obligatory.
