Abstract
Abstract
The technological development that we live in nowadays, which is known as the era of the information and
data revolution, has led to the emergence of new means and methods of dealing that were not known a few
years ago. These means have contributed to the speed and ease of obtaining and disseminating information
regardless of its geographical distance. The whole world is living today on the impact of a real information
revolution in various fields. Thus, the adoption of information technology has contributed to transcending the
spatio-temporal limits and getting rid of material carriers, which are undoubtedly radical and profound
transformations that represent a turning point in human history and a qualitative shift in the behavior of
individuals and groups that has led to the creation of new rules in dealing that warn of approaching the end of
the paper age and its replacement by the age of digitization.
Despite the positivity of this technology and its advanced technical means and its constructive fruits in
various fields, it has raised many legal problems, especially in the field of proving the actions that take place
through modern means of communication, the authentication of its content, and its issuance from which it was
attributed to without distortion, alteration or change. This is because it concludes in a virtual environment
between parties that do not have a prior legal relationship, and who are not united by one council. Also, some
of them may not know each other, in addition to the lack of security and confidentiality elements of these
behaviors as a result of piracy and illegal interference to which they are exposed, which established the
impression that electronic means are untrustworthy.
As a result, it has been necessary to enclose this type of transaction with effective protection to ensure the
identification of the contracting parties and the truth and content of the transaction on the one hand, and to
preserve the sanctity of private life and to devote the confidentiality of the transmission of information on the
other hand.
Since the law is a mirror of reality, legislators have to keep pace with technological developments and
create the necessary electronic environment to accommodate them by issuing legislation - international and
national - that deals with the new means and methods for concluding and signing contracts in a manner that
suits the electronic media through which they are made. The Algerian legislator has tried to catch up to move
forward in this field and counter the criticism leveled against it, as a result of his delay in this field. This was
through the amendment of the rules of evidence and the recognition of electronic means of proof under Law
No. 05-10 amending and supplementing the Civil Code. Then, the legislator issued the issuance of Executive
Decree No. 07-162, which subjected the electronic certification activity to the licensing system received by the
Postal and Telecommunication Control Authority. At the same vein, Law No. 15-04 was issued specifying
the general rules related to electronic signature and certification. To later strengthens the legal texts related to
electronic transactions, Law No. 18-05 related to electronic commerce was issued.
Through these legal texts, the Algerian legislator has devoted several legal mechanisms with the aim of
ensuring the safety of electronic exchanges and achieving confidence and security among dealers via the
information network. In the foreground is the reliance on electronic signature as a mechanism to prove
electronic transactions. The importance of this technology lies in increasing the level of security and privacy in
transactions, and its ability to maintain the confidentiality of information and correspondence so that no one
else can views, modifies or distorts it. It can also identify the identity of the sender and receiver electronically
to ensure the credibility of their identity, which allows detecting any fraud or manipulation in this field. On the
other hand, neutral parties have been resorted to in order to document electronic transactions. This can be
obtained through adopting the electronic certification mechanism that works to create a secure electronic
environment for dealing through the information network. The electronic certification bodies play the role of
trusted intermediary between the dealers in electronic exchanges, confirming the identity of the parties and
determining their eligibility to deal, as well as ensuring the integrity of the content of the data circulated
through the network, and issuing certification certificates electronically to document
