Summary: Our research on human rights between the Islamic conceptualization and the Western vision led us to draw a number of conclusions covering a wide range of related topics, starting from the very foundation of the general and the philosophical concept of human rights, the universal value of human rights where the Islamic law (Charia) is applied, to the search of the desired universal rights philosophy and the obstacles set against the universality of these concepts. The diversity of human rights sources correlates positively with the diversity of those concepts and their impact on the practice of rights and their enforcement on the ground. In fact, there is an almost explicit correlation between the law and rights, assuming that the latter are generated from the law. Although there are great variations on the concept of "right", identifying human rights remains one of the most thorny issues, given the very broad area of topics it covers. However, our research question is not merely a matter of looking for a comprehensive definition of human rights nor a matter of showing their different classifications, but it is essentially an attempt to come up with a peaceful solution seeking to put an end to the question of "westernization of human rights which gives a universal dimension to the specificity of a given community on the one hand and, excludes the identities of other peoples on the other hand. In thisregard, it is worth mentioning that the dialectic of "universality' and 'specificity is not a controversial issue; it is much more a question of organization. In sum, it is obvious that there is a large difference between the principle of universality and the idea of secular philosophy. To put it in more accurate words, we should make a clear distinction between the divine legislation, created by the God of all humans to all humankind and the human legislation, made by a group of humans to all humankind! In addition, we have concluded that the divergence of the essential starting points for human rights do not necessarily result in the contradiction of the contents or in the impossibility of reconciling them. Thus, specificity is not ineluctably contradictory to universality. Rather, it can be regarded as an asset in the sense that it paves the way to the achievement of a comprehensive legal system respecting differences as well as the attainment of the utmost degree of agreement among the internationalcommunity. We encourage the establishment complementary traitsbetweencivilizations and support their openness on each other. of However, that should not be done at the expense of the elimination of the distinctive features or even the existence of the others in the wide scope of human civilization. There is no doubt that creating such a gap in the social nature, the values and the ethics of identities will cause considerable split within the group and eventually a collapse of the individual. It could also induce the individual into a culture based on non-human standards. Do human rights concepts that contribute to the marginalization of human and ethical values and the estrangement of the human being deserve to be named so?! On the contrary, we notice that the Islamic law is based essentially on the idea of the universality of the human being. It recognizes the distinctive nature of the human soul and provides it with all the possible tools to perceive the truth aiming at achieving an ideal. monotheism and a pure worship of Allah through the education and refinement. Furthermore, we observed a number of great hurdles facing human rights principles in the modern era; the most serious one is their inefficiency in many cases. As we all know, there is no legal instrument to oblige States or individuals to abide by those principles. However, we can easily notice that Islam has come with both the right and the instrument to enforce it. The Islamic law considers "rights" as duties to be accomplished by the individual and the State, and if ever they are breached, the party which is held responsible for that will be punished in the worldly existence and in the hereafter. From all the details mentioned above, it is obvious and indisputable that Islam was pioneer and most credible at all the levels in recognizing human rights, setting guarantees to put them into practice and imposing their respect. Recognizing human rights in the divine legislation is considered as "worship". As a result, observing their respect and punishing people denying or disobeying them is also considered as "worship". In fact, the main reason beyond establishing a comparison of the concept of human rights between the Islamic standpoint and the Western vision is to invite objectively and from a purely legal point of view all people around the world to follow the Islamic model in human rights. 758 | |
