الحماية الجنائية لحرمة الميت في الشريعة الإسلامية والتشريع الجزائري

Abstract

تعتبر حرمة الانسان من أكبر المحرمات وأوجبها صونا، فهي غير مقيدة بحياته، بل هي باقية في الحياة وبعد الممات، إلا أنه في ظل التطورات الطبية الحاصلة في العالم ازداد التطلع الى الاستفادة من أعضاء وأجزاء جثث الموتى في كثير من الميادين والمجالات الطبية والتعليمية، مما أدى ذلك في كثير من الأحيان الى الاعتداء على حرمتها وانتهاكها. ومن الأكيد أن حوادث الاعتداء على تلك الحرمة من أهم الموضوعات الجديرة بالبحث والدراسة وذلك بهدف ابراز الحكم الشرعي والموقف القانوني منها، لاسيما مع كثرة انتشار الانتهاكات والاعتداءات الواقعة على حرمة الموتى وخاصة على أجسادهم وتكرارها بشكل لافت للانتباه. لذا ونتيجة لكثرة الاعتداءات والأفعال التي أصبحت تتعرض لها المقابر ، فقد اتجهت جل التشريعات الوضعية ومن بينها المشرع الجزائري إلى سن نصوص قانونية تجرم هذه الأفعال وتكفل حرمة الأموات وتعزيز الحماية المقابرهم، حيث رتبت على انتهاك حقوق الميت عقوبات زجرية سواء كان ذلك منصب على جثته أو على قبره وكل ما يتعلق به، وبذلك تكون قد طبقت مقاصد الشريعة الإسلامية السمحة والتي تدعو إلى احترام وتوقير الأموات.
