The first chapter focused on the conceptual framework of real estate activity, where the Algerian legislator defined the real estate developer as a natural or legal person who has obtained official accreditation, practicing activities related to real estate development as an economic and commercial aid. The study also addressed the development of the legal and regulatory framework for real estate activity through the various stages, and highlighted the importance of this activity in improving the exploitation of urban real estate and controlling the relationship between its actors, while shedding light on the legal controls that determine the conditions for practicing the activity, such as acquiring the status of real estate developer and the conditions for accreditation. The study showed the integration between the Real Estate Development Law (11-04) and other legislation such as ممخز الجارسة 488

economic laws and investment laws, reflecting a comprehensive vision aimed at supporting real estate activity in the service of the national economy, by providing the necessary means and resources to develop real estate projects and stimulate economic growth. In the second chapter, the thesis addressed the legal dimensions of the real estate developer acquiring the status of a merchant, and the various legal effects that result from this. The thesis defined the basic contracts that the real estate developer resorts to, such as the design sale contract, the right reservation contract, and the lease sale contract, as these contracts are considered innovative means that provide flexibility to beneficiaries and enable them to obtain real estate easily. The study also focused on the legal responsibilities of the real estate developer, which vary between tortious liability resulting from legal errors and contractual liability resulting from breach of contractual obligations. The thesis highlighted the role of the real estate developer in adhering to competition laws, by providing competitive services that enhance consumer welfare, and respect for investment laws by providing the appropriate environment for investment and achieving economic development goals. The study concluded that real estate activity, thanks to its association with the legislation regulating it and its integration with other laws, plays a major role in stimulating economic growth and promoting sustainable development. It also recommended the need to strengthen legal and regulatory mechanisms to ensure effective oversight of real estate developer activity, while providing training and qualification programmes to develop their competencies, and encouraging incentive policies in the real estate sector to ensure the achievement of economic and social development goals in Algeria Keywords Legal nature, real estate developer, Algerian legislation
