Abstract

Abstract: Law No. 04-02 relating to commercial practices is considered one of the most important legal texts regulating the rules applied to these practices. Through this law, the Algerian legislator enshrined integrity and transparency in commercial practices among economic agents, and between them and consumers, as one of the pillars of the market economy. This includes various commercial activities from production to retail, as well as service activities. This law is closely linked to Competition Law Decree No. 03-03, which aims to protect competition from restrictive practices while safeguarding economic agents and consumers. This protection has two dimensions: protecting the freedom of commercial practices and curbing violations by economic agents, ensuring that absolute freedom is restricted where it might harm competing economic agents. The Algerian legislator has enshrined this freedom through the evolution of the principle of freedom of trade and industry in successive constitutions since 1996, incorporating the principle of freedom of investment. Commercial practice is a direct outcome of this evolution, and the legislator has increasingly focused on its freedom despite existing limitations. This thesis sheds light on the legal frameworks dedicated to the freedom of commercial practices, as well as the nature of the restrictions imposed upon them. Keywords: Commercial practices – Competition – Consumer protection.
