ازدواجية عقد الزواج في التشريع الجزائري

Abstract

ملخص: تعتبر العلاقة الزوجية من أقدس الروابط التي تجمع بين الرجل والمرأة؛ حيث حظيت برعاية وصيانة فائقة من قبل الشريعة الإسلامية والمشرع الجزائري. غير أن الواقع العملي والتنظيم المعمول به حالياً يخضع لنظامين مختلفين: نظام يرتب عقداً رسمياً، ونظام آخر ينتج عقداً غير رسمي (عرفي). أدت هذه الازدواجية إلى التأثير سلباً على قدسية هذا الرابط وعلى آثاره القانونية، نظراً لأن القانون لا يعترف بالزواج غير الرسمي إلا بعد تثبيته وتسجيله بأحكام قضائية؛ مما فتح المجال أمام بعض المتحايلين لاستغلال هذا الوضع لأغراض تنافي مقاصد الشريعة والقانون. تهدف هذه الدراسة إلى تسليط الضوء على هذين النظامين، وبحث الإشكالات القانونية والعملية الناجمة عنهما في المجتمع الجزائري، مع محاولة استقراء قصد المشرع من خلال نصوص قانون الأسرة الحالي، وصولاً إلى اقتراح صياغة تشريعية جديدة وحلول بديلة. وقد خلص البحث إلى أن كلا العقدين يستوفيان الأركان الشرعية وفقاً للفقه الإسلامي، إلا أن الزواج غير الرسمي يفتقر إلى آلية التوثيق الرسمي لحماية الحقوق. ولذلك، توصي الدراسة بضرورة تدخل المشرع الجزائري بشكل عاجل لتوحيد المنظومة، وتجريم عدم توثيق عقد الزواج في قانون العقوبات لسد الباب أمام النوايا الخفية، وتعديل النصوص ذات الصلة في قانون الأسرة للقضاء نهائياً على هذه الازدواجية. الكلمات المفتاحية: عقد الزواج، الرسمية، التوثيق، الازدواجية، الرابطة الزوجية. One of the Most important Relation ship Benwee a man and a woman is the sacred Relationship. That préserves their dignity and regulates their lives, which is based on the marriage contract, which is considered a specific contract and defines the pillars and conditions; It was sacredly protected by Islamic law in the Noble Qur’an and the Prophetic Sunnah, as well as by the Algerian legislator. However, the regulation currently in force in concluding the marriage contract is subject to two different systems A system arranges an informal marriage contract, and another system arranges an official marriage contract, which resulted in a double marriage contract, and this duplication that affected the marriage contract negatively affected its sanctity and its effects, because the law does not recognize informal marriage until after it is confirmed and registered before the judiciary. This situation is present, continuous and adopted by those wishing to marry, which opened the door for some fraudsters to use it for their purposes contrary to the purposes of the marriage contract called for by Islamic Sharia and law. Which removes all ambiguity, so this study aims to shed light on these two systems that extended the marriage contract and the resulting problems, and try to identify what he mean.the Algerian legislator in family law through the formulation that came in his texts related to the subject of the study and clarifying its effects from the practical point of view and its repercussions on the reality of Algerian society and its components, as well as proposing a new formulation, and providing alternative solutions. I have concluded at the end of this research that the formal and informal marriage contract are legitimate contracts according to Islamic law, however, informal marriage is a marriage that is not registered before the official authorities. Those with hidden intentions, and therefore, to protect the marriage contract from this violation requires quick intervention by the Algerian legislator, who we call on to criminalize the lack of documentation of the marriage contract to prevent it, and to punish anyone who concludes it with deterrent penalties and stipulating them in the penal code, as well as amending the contract of legal texts.
