Abstract
Abstract:
The traditional international law allowed the use of armed force which was considered as a matter of state sovereignty, as a result the international community witnessed several disastrous wars that had affected all human beings. However, the development of the international relations and. international law, especially after The First World War, urged the international community to make considerable efforts in order to prohibit the use of armed power in international relations and appealed in the name of the peoples of the world and humanity conscience for the necessity of rejecting war and avoiding armed conflicts, and that it was time to live in peace.
Despite the efforts of the international community made during the League of Nations to restrict the use of war and the prohibition of aggression, then during the era of the United Nations Organization, which prohibited the use of power, the international reality witnessed several international and non-international armed conflicts, and many interventions by Western countries headed by the United States of America which interfered in the affairs of other states, on the pretext of protecting human rights and the consolidation of the principles of democracy arguing that this intervention is dictated by the human duty; As it used preventive war, invoking the right of self-defense and the disarmament of mass destruction weapons to fight international terrorism.
However, it seems through international practice that Western countries respect the provisions of international law of European origin in their relations only and are not interested in them when it 's about other countries, in particular Third World countries and especially Arab countries. The West continues to underestimate these countries and consider them as if they are still its colonies with the sole purpose of safeguarding its interests by plundering oil wealth, provoking conflicts and fighting the values of Arabs and Islamic societies.
The broadening of the interpretation of the concepts of international peace and security and the right to self-defense has paved the way for the use of armed force in international relations, which has led to the violation of international legitimacy, the threat to world peace and the spread of chaos, and has created many problems, the most important one was the efficiency of the rules of international law, in particular imperative rules.
The West, led by the United States, decides the fate of vulnerable people even if it violates international legitimacy. Moreover, it influences the decisions of the United Nations, which has become incapable of achieving international peace and security, leading to the occupation of certain countries under various pretexts to achieve hidden objectives, depriving other peoples of their right to self-determination and independence.
