| dc.description | One of the Most important Relation ship Benwee a man and a woman is the sacred Relationship. That préserves their dignity and regulates their lives, which is based on the marriage contract, which is considered a specific contract and defines the pillars and conditions; It was sacredly protected by Islamic law in the Noble Qur’an and the Prophetic Sunnah, as well as by the Algerian legislator. However, the regulation currently in force in concluding the marriage contract is subject to two different systems A system arranges an informal marriage contract, and another system arranges an official marriage contract, which resulted in a double marriage contract, and this duplication that affected the marriage contract negatively affected its sanctity and its effects, because the law does not recognize informal marriage until after it is confirmed and registered before the judiciary. This situation is present, continuous and adopted by those wishing to marry, which opened the door for some fraudsters to use it for their purposes contrary to the purposes of the marriage contract called for by Islamic Sharia and law. Which removes all ambiguity, so this study aims to shed light on these two systems that extended the marriage contract and the resulting problems, and try to identify what he mean.the Algerian legislator in family law through the formulation that came in his texts related to the subject of the study and clarifying its effects from the practical point of view and its repercussions on the reality of Algerian society and its components, as well as proposing a new formulation, and providing alternative solutions. I have concluded at the end of this research that the formal and informal marriage contract are legitimate contracts according to Islamic law, however, informal marriage is a marriage that is not registered before the official authorities.
